What Is a Notice of Claim?

A Notice of Claim is a formal written statement that tells a government body, public agency, insurer, or other responsible party about an injury claim. The notice usually identifies the incident, the injured person, and the harm involved. A notice may preserve a claim process, but it does not replace a lawsuit or prove liability.

Key Takeaways About Notice of Claim

  • A notice may apply to public entities or private insurers.
  • The document should connect the incident to the claimed injury.
  • A notice is not the same as filing a lawsuit.

How Notice of Claim Works

A Notice of Claim gives the responsible party formal information about an alleged injury and the event connected to it. The recipient may be a bus company, government agency, insurer, or another organization. The document typically describes the location, circumstances, claimed harm, and available contact information.

The notice creates a record that the claim was presented. Its effect depends on the recipient and the rules governing the claim. A bus accident claim may involve more than one recipient, especially when a public transit system, private operator, driver, or insurer has a role. The notice does not establish fault, calculate final damages, or replace the evidence needed to support the claim.

From the Atlanta Auto Law team

When we handle a bus accident claim, we identify every organization that may require notice and check the applicable notice process. We compare the incident details with available records, such as crash reports, medical records, and vehicle information. We also track submitted notices and responses so the claim record stays organized.

Notice of Claim in Practice: A Real-World Example

A passenger suffers a back injury after a bus collision. A Notice of Claim may describe the route, location, collision, injury, and responsible entities, then preserve the passenger’s claim process while the supporting evidence is gathered.
