How Guardian ad Litem Works

A hand holds a card reading “GUARDIAN AD LITEM” with a shield icon and text about a child’s interests

A Guardian ad Litem gathers information about the child’s situation and reports findings to the court. The investigation may include reviewing medical records, speaking with parents and providers, and considering the child’s care needs. The representative does not simply adopt a parent’s position.

The court decides how much weight to give the report and recommendation. In a birth injury claim, the review may address whether settlement terms protect funds needed for future treatment, therapy, equipment, or daily support. The representative’s role ends when the court no longer needs independent input about the child’s interests.
